However, until recently, college athletes were not allowed to monetize their name, image or likeness (NIL). Then, in 2021, the U.S. Supreme Court overruled that standard. Today, student athletes can now benefit financially from their NIL\u2014and that income is taxable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here\u2019s what you need to know about NIL rights and their tax implications.<\/p>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-is-name-image-and-likeness-income\"><strong>What is Name, Image, and Likeness income?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Name, Image, and Likeness (NIL) is the use of a student-athlete\u2019s name, image or likeness through marketing and promotional activities. Student-athletes can now earn income derived from those activities and are required to pay applicable taxes.<\/p>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-kind-of-nil-activities-can-you-earn-money-from\"><strong>What kind of NIL activities can you earn money from?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">NIL activities you can earn income from include:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Signing autographs<\/li>\n\n\n\n<li>Monetizing social media accounts<\/li>\n\n\n\n<li>Teaching camps or lessons<\/li>\n\n\n\n<li>Participating in advertising campaigns<\/li>\n\n\n\n<li>Sponsorships and endorsements<\/li>\n\n\n\n<li>Gifts and giveaways<\/li>\n\n\n\n<li>Licensing via non-fungible tokens (NFTs)<\/li>\n\n\n\n<li>Exhibitions<\/li>\n\n\n\n<li>Guest appearances<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Keep in mind that any money, goods, or property earned through NIL activities is considered taxable income and should be reported to the IRS. This includes non-cash benefits and compensation.&nbsp;<\/p>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<div class=\"wp-block-buttons is-content-justification-center is-layout-flex wp-container-core-buttons-is-layout-fe48e5de wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button has-custom-font-size has-medium-font-size\"><a class=\"wp-block-button__link has-white-color has-luminous-vivid-orange-background-color has-text-color has-background has-link-color wp-element-button\" href=\"https:\/\/www.eztaxreturn.com\/?utm_dest=site&amp;action=start_return&amp;utm_source=blog&amp;utm_medium=blog&amp;utm_term=NIL&amp;gid=NIL\" target=\"_blank\" rel=\"noreferrer noopener\">Get Started Now<\/a><\/div>\n<\/div>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-are-nil-earnings-taxed\"><strong>How are NIL earnings taxed?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">NIL income is taxable income\u2014but how it is taxed will depend on the student-athlete\u2019s employment status and whether they can be claimed as a dependent on their parents\u2019 tax return.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Student-athletes that file their own returns will have to pay federal tax if they earn more than $13,850 (for single filers) in 2023, since that is the standard deduction for tax year 2023. And all athletes that make at least $400 in NIL activities will have to fill out a tax return to report and pay their self-employment taxes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here\u2019s how to report NIL income to the IRS.<\/p>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-1-determine-your-employment-status-nbsp\"><strong>1. Determine your employment status.&nbsp;<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Student-athletes should determine upfront whether they will be considered an employee or independent contractor before accepting NIL money. Document and track all NIL income and expenses.<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">All NIL activities that generate income should be carefully recorded for tax purposes. Note both income as well as any expenses incurred to generate that income. If the income exceeds $600, you should receive a Form 1099 from the client(s) paying you.<\/p>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-3-determine-your-taxable-income\"><strong>3. Determine your taxable income.<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">File a <a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f1040sc.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Schedule C, Profit or Loss from Business<\/a> and a <a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f1040se.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Schedule E, Supplemental Income and Loss<\/a>, with Form 1040 to determine taxable income for the year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on income, filing status, and qualifying situations, student-athletes and\/or their parents may be eligible for certain <a href=\"https:\/\/staging.eztaxreturn.com\/blog\/tax-credits-vs-deductions-whats-the-difference\/?utm_source=blog&amp;utm_medium=blog&amp;utm_term=NIL\" target=\"_blank\" rel=\"noreferrer noopener\">tax credits and deductions<\/a>, such as the <a href=\"https:\/\/staging.eztaxreturn.com\/blog\/what-is-the-earned-income-tax-credit-eitc\/?utm_source=blog&amp;utm_medium=blog&amp;utm_term=NIL\" target=\"_blank\" rel=\"noreferrer noopener\">Earned Income Tax Credit<\/a> and <a href=\"https:\/\/staging.eztaxreturn.com\/blog\/education-credits-that-can-lower-your-tax-bill\/?utm_source=blog&amp;utm_medium=blog&amp;utm_term=NIL\" target=\"_blank\" rel=\"noreferrer noopener\">American Opportunity Tax Credit<\/a>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Keep in mind that if you are providing more than half of your own support, your parents will not be able to claim you as a dependent on their tax return. However, even if your parents can claim you as a dependent, if they are not eligible for tax credits like the American Opportunity Tax Credit due to their income, it may be better to file your own taxes so you can claim those benefits.<\/p>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-4-calculate-and-pay-estimated-quarterly-payments-on-taxable-income\"><strong>4.
